§1The agreement
These Terms of Use are a contract between you and Monadly(“we”, “our”) covering the PinWorth iOS application (the “App”) and the pinworth.app website. By installing or using the App you accept these terms; if you do not accept them, do not use the App. Where the App is delivered through the App Store, Apple's standard Licensed Application End User License Agreement also applies, and Apple is a third-party beneficiary of these terms with the right to enforce them.
§2What PinWorth does
The App identifies trading pins from photographs you submit, retrieves catalog records, assembles AI-generated appraisals with value ranges, displays related market evidence, and organizes your saved pins into boards, wishlists, and a portfolio total. Features may change, improve, or be retired as the product evolves.
§3Appraisals are estimates — not advice
This section matters more than any other. Identification results, condition assessments, value ranges, portfolio totals, and market evidence are automated estimates produced from photographs, catalog data, and third-party market signals, all of which can be incomplete, delayed, or wrong.
- A value range is not an offer, a quote, a certified appraisal, or a promise that any pin will sell at any price.
- PinWorth is not a marketplace, broker, auctioneer, escrow service, or financial, investment, tax, or legal adviser.
- Matches can be incorrect; counterfeit pins may not be detected; market data reflects sources, not truth.
- Decisions to trade, buy, or sell are yours alone. Verify independently before money or grails change hands.
§4Your account
Signing in with Apple or Google is optional but required for backup and sync. You are responsible for activity under your account and for keeping access to your sign-in provider secure. You must be at least 13 years old (or the digital-consent age where you live) to create an account.
§5Premium subscriptions
Free scans let you try the App. PinWorth Premium unlocks unlimited scanning, full market evidence, and collection tracking, billed as an auto-renewing subscription through your Apple Account:
- Payment is charged at confirmation of purchase.
- The subscription renews automatically unless cancelled at least 24 hours before the current period ends.
- Manage or cancel anytime in iOS Settings → Apple Account → Subscriptions.
- Refunds are handled by Apple under App Store policies; prices may change with notice before a renewal.
- Unused free allowances have no cash value and do not roll over.
§6Your photos and content
You keep ownership of the photos you scan and the notes you save. You grant us a limited, worldwide, royalty-free license to host and process that content for the purposes described in our Privacy Policy— producing your results, syncing your collection, and improving recognition quality. You promise your submissions do not violate anyone else's rights or any law.
§7Rules of the road
Do not:
- Reverse engineer, scrape, crawl, or bulk-extract the App, its catalog, or its appraisal outputs.
- Resell, sublicense, or commercially redistribute results without our written permission.
- Probe, overload, or interfere with the service, or bypass usage limits and security controls.
- Use the App to deceive other collectors — including misrepresenting an appraisal as a certification.
- Submit unlawful content or use the App where prohibited by law, including in violation of U.S. export rules.
§8Intellectual property
The App, the Site, their design, software, and editorial content belong to Monadly and its licensors. Pin artwork, character names, and trademarks visible in scanned pins or catalog entries belong to their respective owners — including The Walt Disney Company — and appear only to identify and describe collectibles. PinWorth is an independent product with no affiliation, sponsorship, or endorsement from any such rights holder.
§9Third-party services
Market evidence and other features depend on third-party platforms and data sources that we do not control. Their availability, accuracy, and terms are theirs; outages or changes on their side are not a breach of these terms on ours.
§10Disclaimers
The App is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant uninterrupted or error-free operation.
§11Limitation of liability
To the maximum extent permitted by law, Monadly will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or losses arising from trades, purchases, or sales made in reliance on App output. Our total liability for all claims in any twelve-month period is capped at the greater of fifty U.S. dollars or the amount you paid us in that period. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
§12Indemnity
You will defend and hold harmless Monadlyfrom claims and expenses (including reasonable attorneys' fees) arising from your content, your trades, or your breach of these terms.
§13Ending things
You can stop using the App and delete your account at any time. We may suspend or terminate access that violates these terms or threatens the service, and we may discontinue the App with reasonable notice. Sections 3 and 8 through 15 survive termination.
§14Changes to these terms
We may revise these terms as the product and the law evolve. The effective date above reflects the latest revision; material changes will be announced in the App. Using the App after a revision takes effect means you accept it.
§15Governing law and contact
These terms are governed by the laws of the United States and the state of our principal place of business, without regard to conflict-of-law rules, and disputes will be resolved in the courts located there unless your local law gives you a non-waivable alternative.
